Do you have a copy of their product?

The GPL only says that you have to either include a copy of the source, 
or an offer for same (with the
binary, and that you can charge (nominally) for making the copy.

Until you've got a copy of his (company's) product in your hands, you 
don't have much claim under the GPL.
